The Court of Justice of the European Union has dismissed the appeal for omission brought by the European Parliament against the Commission for not suspending the visa exemption for US citizens under the principle of reciprocity, taking into account that this country imposes the need to visa to citizens of several member states of the European Union.
Union law seeks to ensure full reciprocity in visa matters. Thus, in principle, only third States that grant visa exemption to nationals of EU Member States will enjoy such an exemption. But if a State exempt from said obligation decides to subject the nationals of one of the States of the community bloc to the visa obligation, the European Commission has a margin of appreciation to decide whether this exemption is appropriate.
The United States imposed this obligation on the nationals of Bulgaria, Croatia, Cyprus and Romania , so the European Parliament, taking into account the reciprocity mechanism and reacting in solidarity as a group, urged the European Commission to suspend this exemption from which they enjoy. The Commission, however, considered it inappropriate to suspend the exemption due to the “disastrous political and economic consequences that it could have for the Union.” This decision led Parliament to file an appeal for omission.
